Everything You Need to Know About the Vape Mail Ban 2021

As of October 21, 2021, the United States Postal Service (USPS) will no longer ship and deliver vaping products. This new rule may come as a shock for many, but it has been in the works for nearly a year.

In fact, the USPS is one of the last major carriers to stop delivering vape products. Now you might be wondering—does the vape shipping ban mean all vape products, or just certain types, and what happens next?

Why Did Shipping Carriers Ban Vape Delivery?

In December 2020, Congress quietly passed a bill called the Preventing Online Sales of E-Cigarettes to Children Act (POSECCA). This law was passed to try and keep children from getting their hands on e-cigarettes.

Lawmakers argued that e-cigarettes could easily be purchased online by minors. Now, having to show up in person at a store will make it easier to regulate the sale of vape products and limit the access children have.

As we mentioned, The USPS was the last major mail carrier to stop shipping vapes directly to consumers. UPS banned the delivery of vapes on April 5, 2021, and FedEx stopped on March 1, 2021.

Does the Vape Shipping Ban Include CBD Products?

At first glance, it seems like only e-cigarettes are caught in the current ban. After all, Congress' main goal was to regulate e-cigarettes and e-liquid.

However, hemp products like CBD vapes are caught in the crossfire. The language used in the POSECCA bill basically created a sweeping ban on all types of vapes.

To quote the law itself, the USPS may not deliver:

(1) any electronic device that, through an aerosolized solution, delivers nicotine, flavor, or any other substance to the user inhaling from the device; and (2) any component, liquid, part, or accessory of an ENDS, regardless of whether sold separately from the device."

The “any other substance” part is the language in the law that also consequentially banned shipping hemp/CBD vapes. As you can see, the language is incredibly vague.

Whether or not Congress intended to ban CBD vape products, we may never know. More than likely, they simply wanted to sweep the whole thing into one category and call it a day.

Sadly, this bill is going to have huge repercussions on the vaping industry as a whole. That's because the second part of the law bans vaping devices too.

An ENDS is an Electronic Nicotine Delivery System—which sounds just like an e-cigarette. The thing is, Congress uses ENDS to describe any type of vape device, not just e-cigarettes.

That means liquid or not, all vape products are now banned from being sent in the mail.

Are There Any Exceptions to the 2021 Vape Ban?

There are a few exceptions to the vape mail ban. The first is business-to-business (B2B) shipping, also known as wholesale or retail shipping.

However, the B2B shipping rules are intentionally tricky. Businesses must first apply and be approved for the B2B exemption.

It doesn't end there, because the red tape from POSECCA makes shipping and receiving vape products through USPS extra slow and inefficient.

Private individuals can also send vape products to someone, but no money can change hands. If you want to ship your friend a vape product, then that's fine.

Just be sure to not send more than 10 packages of vape products during a 30-day period.

Lastly, Alaska and Hawaii still allow businesses to ship to consumers. However, companies can't ship vapes out of state through USPS and will still likely need to use a private delivery service.
